User Guide Series - How to Locate IP Periodicals

When a researcher is faced with a new topic, a helpful resource are legal periodicals.   Legal periodicals often discuss the ramifications of particular decisions and include insights on where the direction of the law is going.   Furthermore, legal periodicals are helpful because the footnotes direct the researcher to a broad array of legal authority, including cases, statutes, regulations, state and federal law, treatises, and other legal periodical articles.   The Franklin Pierce Intellectual Property Law Library has many periodicals that pertain to a wide variety of intellectual property topics.

I. Periodicals available at FPLC
To find articles on certain topics, the researcher should know what periodicals are available at Franklin Pierce.   There are a two tools for locating periodicals available at Franklin Pierce.   The most obvious are the periodicals themselves.   At Franklin Pierce, most of the current issues of leading intellectual property periodicals are kept on the display shelves on the third floor library.   The other tool is the Periodical Holdings notebook that lists all the periodicals available at Franklin Pierce.   The following is a list of intellectual property periodicals available as of 12/1/96:

II. Finding articles
When looking for an article in a particular periodical, the task is easy.   Just go to the periodical and read.   However, if the researcher has a topic and is unsure of which periodical they should look at, the task involves a little more work.   There are a number of tools available for finding articles at FPLC; the Index to Legal Periodicals, the Current Law Index, LegalTrac, Westlaw and Lexis. All of these resources being located on the first floor of the library.

A. The Index to Legal Periodicals
The index includes cumulative volumes with the articles from over five hundred periodicals, dating back to 1908, arranged under subject headings.   Once the correct subject heading is located, the titles to the article are listed under that subject heading alphabetically.   To completely search the Index to Legal Periodicals, the researcher should consult headings in the latest annual volume and the recent monthly issues of the Index.   To be through, the researcher should continue to research the headings in the annual volumes backwards until 1980 and then triennial volumes until the researcher is confident that they have enough articles to read.

If the researcher has an author's name, the researching task is made easier.   The Index indexes articles alphabetically by author.

The Index also contains two kinds of tables.   First, in all volumes, there is a Table of Cases, which gives the researcher citations to articles analyzing a single case.   This table is only useful if an article is needed that analyzes a particular case.   Second, volumes 20-the present include a Table of Statutes Commented Upon.   This index is available on CD-ROM but not at FPLC.   It is also on Lexis and Westlaw.

B. Current Law Index
In addition to the Index to Legal Periodicals, the Current Law Index also provides help for finding the right article for researching your topic.   The Current Law Index is arranged much like the Index to Legal Periodicals except that in addition to the subject headings, the Current Law Index includes subheadings to make the researching easier.   This index, more comprehensive than the Index to Legal Periodicals, includes cumulative volumes with the articles from over seven hundred periodicals (1000 if you count out of print titles).   There are three sections to the Current Law Index, Author/Title Index, Table of Cases, and Table of Statutes.   This index is available on Lexis and Wesltaw and on the CD-ROM discussed next.

C. LegalTrac
LegalTrac is an electronic card catalogue of legal periodicals going back to 1980.   There are two methods of searching using Legal Trac, subject guide or keyword.   Subject guide searching also the researcher to type in a subject and the computer lists out subheadings and related topics.   Using "intellectual property" as a subject guide, there are 55 subdivisions of that subject area.   Keyword searching permits the researcher to find topics that integrate the keywords typed in.   Using the same terms, "intellectual property" there are 2753 articles available.

D. Lexis and Westlaw
Both Lexis and Westlaw offer the index products described above as well as full text databases available for finding periodicals.   In Lexis one can search full text in the general category under the Secondary Source Library or in the Law Review Library.   In both libraries there are files devoted to Intellectual Property issues.   The file name is IPLR for Intellectual Property Law.   Lexis also includes IP only periodicals in their PATENT, TRADEMARK and COPYRIGHT Libraries.

To use Westlaw for finding periodical articles, one must choose a database by selecting the heading Topical Materials by Area of Practice.   Included as a sub-heading is intellectual property.   The group database for finding periodicals on intellectual property issues is IP-TP.   There are also databases for individual publications.   These can be found by using the topical menus, the print database guide or the IDEN database.

The full text databases on both Lexis and Westlaw are limited in number and coverage.   One big mistake that law students make is to rely on full text databases.   These are not exhaustive.   The best periodical research starts in the Legal Resource Index on Westlaw.   This will give you a comprehensive listing of articles.   From this list you can look at the print versions in the Library or look for the notation <>.   If you see this notation, you can hypertext to the full text of the article and print it offline.   This strategy avoids database time as the jump is at the lower West "find" rate.   The one caveat is that printing offline is costly in the "real world."

Also, try out the WTH-IP on Westlaw and the HOTTOP files in the Lexis PATENT, TRADEMARK and COPYRIGHT Libraries.   These are current awareness services are in the nature of online newsletters.

E. The Internet
There are a growing number of IP periodicals which are only produced for the Web or present selected articles.   This avenue of research will become more important in the future.   For now, a current listing of these periodicals can be found in the IP Mall.
